LIMITED WARRANTY

WARNING: Neither APEX Designs & Performance Products, LLC nor the seller will be liable for any loss, damage, or injury directly or indirectly arising from the use of or inability to determine the use of these products. Before using, the user shall determine the suitability of the product(s) for its intended use(s), and the user shall assume all responsibility and risk in connection therewith.

Apex Designs & Performance Products, LLC warrants APEX products to the original retail purchaser to be free of defects in material and workmanship for two years. 

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; (h) product finish; (i) improperly installed or applied products; (j) improperly maintained products; (k) products used for any racing or competition; or (l) external causes such as accidents, abuse, neglect or other actions or events beyond our reasonable control. The following will VOID the warranty: (a) improper installation; (b) failure to properly maintain product; (c) use of product for racing or competition; (d) neglect or abuse.

All APEX products are warrantied to be free of defects in material and workmanship for two years from date purchased, as long as the original purchaser owns the vehicle on which products were originally installed, unless otherwise specified.  It is the customer’s responsibility to remove the product from the vehicle. Inbound shipping charges (from you to us) are the responsibility of the customer. APEX will evaluate the product to determine the appropriate resolution. The first step in the warranty process is to repair the product. If the product cannot be repaired and a replacement is deemed necessary, a refurbished unit may be provided, subject to availability.

To file a warranty claim please email support@apexdesigns.llc or call our customer service department at 844.414.APEX, Monday thru Friday, 9:00am-5:00pm MT. Closed Saturday, Sunday and all major holidays. All returns must be accompanied by proof of purchase or original invoice.

LIMITATION OF LIABILITY: THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
